During the meeting of the Joint Representative Body of Trade Union Federations at the national level on April 27, 2026, representatives Federation of Transport Trade Unions of Ukraine (FTTU) addressed the members of the Joint Representative Body regarding the need to consider the impact on the rights of Trade Union organizations in Ukraine of the recent decision by the Grand Chamber of the Supreme Court of Ukraine in Case No. 359\/8573\/20. A corresponding appeal to the SPO was sent by the Federation\u2019s President and SPO Vice President Oleksiy SEMERUN\u2019 on April 13, 2026.<\/p>\n\n\n\n

As a reminder, the Grand Chamber overturned the demand by the trade union committee of the \u201cEngineering and Technical Specialists\u201d trade union at the State Air Traffic Services Enterprise of Ukraine to terminate the employment contract with the manager pursuant to Article 45 of the Labor Code and Article 33 of the Trade Unions Act.<\/p>\n\n\n\n

Speaking on behalf of the Federation, FTTU General Secretary Oleksandr Shubin noted: \u201cThe court\u2019s ruling affects every primary trade union organization in Ukraine that plans to exercise its right to demand the dismissal of a company executive for violating labor laws or collective bargaining agreements. The court has introduced the principles of the \u2018materiality\u2019 of a violation and the requirement that the basis for dismissal be precisely a violation of collective interests. And this sets a dangerous precedent, since preventing systemic violations of individual workers\u2019 rights is, in and of itself, their collective interest.\u201d<\/p>\n\n\n\n

The outcome of the SPO review may be a statement, a decision to continue the legal battle for its position at the ECHR, or other decisions. In any case, the Labor Union community must receive guidance and recommendations from the SPO regarding further actions, as this court ruling affects everyone. Moreover, the draft of the new Labor Code does not include the provisions of Article 45 of the Labor Code and Article 33 of the Trade Unions Act at all. And the demand for their reinstatement in one form or another, in our opinion, is a direct task for the trade union negotiating team on labor law reform.<\/p>\n\n\n\n

Oleksiy Smolskyi, a member of the Trade Union Council, Deputy Chairman of the FTTU, and President of the All-Ukrainian Association \u201cFPARRIZU,\u201d stated in his speech: \u201cThe decisions of the Grand Chamber of the Supreme Court are already being treated by judicial bodies as direct instructions to be followed. Today, we already have concrete examples of judges applying them. Trade unions do not have the authority to determine the \u2018materiality\u2019 or \u2018substantiality\u2019 of a violation. Therefore, many employers will simply ignore the demands of primary organizations to hold offending managers accountable. We believe that addressing this issue at the SPO meeting is of the utmost importance.\u201d<\/p>\n\n\n\n

Following the discussion, the proposal to prepare a detailed review of this issue for one of the upcoming meetings of the Joint Committee was endorsed.<\/p>\n\n\n\n

In addition, during the meeting of the Joint Social Council, the trade union side\u2019s proposals for the Budget Declaration for the next period were approved; a significant portion of these proposals were developed based on the work of experts from the Federation of Transport Trade Unions Of Ukraine, the Trade Union of Railwaymen and Transport Construction Workers of Ukraine, and proposals from member organizations.<\/p>\n\n\n\n

Particular attention was paid to the response of the trade union confederations to the new draft law on social dialogue, developed by the National Service for Mediation and Conciliation.<\/p>\n\n\n\n

Commenting on the draft, the General Secretary of the FTTU noted: \u201cAs the coordinator of the trade union team in the working group tasked with drafting amendments to the Law \u2018On Social Dialogue in Ukraine,\u2019 I can say that a significant number of provisions in the draft law received from the National Social Partnership Council came as a surprise to me and the members of the working group, since they were not only not supported by the trade union side but were also not brought up for discussion during the working group\u2019s meetings in the version in which they appeared in the draft law. The criteria for representativeness are puzzling, both in terms of the 10% quantitative threshold and the definitions used, such as \u201cpersons employed by business entities,\u201d which are inconsistent with both current legislation and the terminology used in the draft Labor Code. Clearly, this draft law, as currently proposed, could significantly restrict the trade union side\u2019s access to social dialogue, and therefore the representatives of the trade union federation must take all possible measures to amend these provisions.\u201d<\/p>\n\n\n\n
